END USER LICENSE AGREEMENT (EULA) FOR "ROCKINPLAYER"
====================================================
Date: 2 November 2026 – Software version: 0.9

NOTE: This English text is a convenience translation. In case of discrepancies the German version (EULA.txt) prevails.

Licensor: rockinbearstudios | Olav Däumling, Büelenweg 12, CH-2544 Bettlach SO, Switzerland, https://rockinbear.net

Please read this agreement carefully. By installing or using rockinplayer (the "Software") you agree to these terms.
If you do not agree, you must not install or use the Software.

1. Subject matter
   rockinplayer is a program for listening to, browsing and editing audio files (player, waveform, loudness measurement,
   slicing, conversion). The Software is protected by copyright. All rights not expressly granted to you remain with the
   Licensor.

2. License
   2.1 The Licensor grants you a simple (non-exclusive), non-transferable and non-sublicensable right to install and use the
       Software in the version you acquired, for an unlimited period, on the computers you use personally. A license is for one
       natural person; use by several persons or within a company requires a corresponding number of licenses.
   2.2 You may make a backup copy.

3. Restrictions
   Unless mandatory law provides otherwise, you may not:
   a) rent, lend, sell, pass on or make publicly available the Software or parts of it;
   b) reverse engineer, decompile or disassemble the Software or circumvent protection mechanisms;
   c) remove or alter copyright, trademark or license notices;
   d) modify the Software or create derivative works from it.
   Mandatory statutory rights (e.g. to decompile for the purpose of interoperability) remain unaffected.

4. Third-party software
   rockinplayer contains free software and libraries of third parties (including egui, cpal, Symphonia, flacenc, libvorbis,
   libogg) and the separately supplied library LAME (libmp3lame-0.dll). These components are governed solely by their own
   licenses, which are listed in the file THIRD_PARTY_LICENSES.txt and in the Info window of the Software. Nothing in this
   agreement restricts your rights under those licenses. In particular, you may replace libmp3lame-0.dll with your own
   compatible version (see LAME\LAME-README.en.txt).

5. Use of audio files
   You are responsible for holding the rights to use the audio files that you play, cut or convert with rockinplayer in this
   way. rockinplayer reads files and writes new files only to folders that you expressly choose. Original files are not
   modified or deleted.

6. Privacy
   rockinplayer has no telemetry and requires no registration. Its only network connection is the update check: at startup the
   program fetches the version file from https://rockinbear.net (as with any web access the server sees the IP address and the
   program version; no further data is transmitted). The check can be turned off in the settings. Settings, favorites and
   history are stored exclusively on your computer in %APPDATA%\rockinplayer\ and can be removed by deleting that folder.

7. Updates and support
   The Licensor may provide updates but is not obliged to do so. Help and information are available at
   https://rockinbear.net. This English translation of the agreement (EULA.en.txt) serves for understanding only; in case of
   discrepancies the German version prevails.

8. Warranty and liability
   8.1 Statutory warranty rights apply to the extent that they are mandatory.
   8.2 The Licensor is liable without limitation for intent and gross negligence, for injury to life, body and health and,
       where mandatory by law, under the Swiss Product Liability Act (PrHG).
   8.3 In cases of slight negligence the Licensor is liable only for the breach of essential contractual obligations and
       limited to the foreseeable, typical damage, at most the purchase price. Otherwise liability is excluded to the extent
       permitted by law, in particular for lost profit and loss of data.
   8.4 The Software is not offered for safety-critical applications. Finished recordings and projects should be backed up
       regularly.

9. Term and termination
   The agreement applies as long as you use the Software lawfully. If you breach this agreement, your license ends
   automatically. You must then delete the Software and all copies.

10. Final provisions
    10.1 Swiss law applies, excluding its conflict-of-laws rules (PILA) and the UN Convention on Contracts for the
         International Sale of Goods (CISG). The place of jurisdiction is, where permissible, Solothurn (Switzerland).
         Mandatory consumer protection and jurisdiction rules that apply to you at your place of habitual residence remain
         unaffected.
    10.2 If a provision is invalid, the remainder of the agreement stays valid; the invalid provision is replaced by a valid one
         that comes closest to its economic purpose.
    10.3 Amendments and additions require text form.
